For whom is this Act ?
all taxpayers in france who purchased a new home (or in the future state of completion) between 1 January 2009 and 31 December 2012 can benefit from Scellier Act.

How can you benefit ?
you buy a new real estate already delivered or VEFA and you agree to rent it for use as primary residence for a period of 9 years.
For new homes already sold, the property should not have been inhabited.

Why buy a property with the Scellier Act ?
Unlike other law that you benefit from a reduction in your taxable income, the law introduces the Scellier tax benefit as a reduction made on the amount of your taxes. While the deduction for depreciation (as former Robien or other) would allow the investor to obtain an advantage whose importance was related to the marginal tax bracket, the new reduction of 'would give all the same reduction calculated on the amount invested, regardless of the marginal tax bracket. The reduction is more consistent than it will be 25% of the price of the property spread over 9 years for taxpayers who purchase over the period 2009 - 2010 but 20% for the period 2011 - 2012.

What commitments ?

Under the law, the tax reduction is subject to a commitment to rent housing nu residential principal for a minimum of 9 years. According to defined areas and monthly rent ceilings established by the decree.
This law is limited to the purchase of a property (new) per year. It must be located in metropolitan France or in overseas territories (Guadeloupe, Martinique, Guiana and Reunion).
One dwelling per year is awarded and the selected investment ceiling is 300 000 €.
Rents must not exceed the ceiling fixed by decree as the old devices Robien / Borloo.


Things to Remember
with the Scellier Act

  • Reduce your tax: up to 25% of your real estate purchase during the first 9 years up to a ninth annuity. (approximately 2.77% of the price of the property per year) for acquisitions over the period 2009 - 2010. For acquisitions made between 2011 and 2012, the reduction will be more than 20% of the price of the property.
  • Allow a reduction in tax at a rate of 2% per year for 6 years at the end of those 9 years if it agrees to comply with a ceiling of resources from the tenant.
  • No tax bracket minimum benefit, the law Scellier * is for all taxpayers french investing in new housing in 2009 and 2010 (housing for rent).
  • The loan interest charges and real can be deducted in the case of the social law Scellier *.
* This is no longer a deduction on income as under the Robien Act or Borloo Act, but rather a "tax reduction" over 9 years and carried over the next 6 years at 2% per year
